Patrick follows the DP World lead on surcharges – will any regulator intervene?

Effective 10 July 2017, the new Patrick "Infrastructure Surcharge and Ancillary Charges" will add significant costs to Australia's international trade sector. If this is not bad enough, of much greater concern is that there appears to be no commercial mechanism or desire from any regular to control pricing administered by our stevedores.

Perhaps saying that our regulators have no desire to support the sector is too harsh. Preliminary indications are that regulators simply do not have the power to intervene. If that turns out to be the case, then laws must be introduced to protect our important sector of commerce.

Following the recent introduction of a similar surcharge by DP World, this charging regime by Patrick comes as no surprise. While there is absolutely no suggestion of collusion between the stevedores, it is another case of "follow the leader".

Cargo owners cannot exercise market power as some interested parties would have you think. Exporters, importers and freight forwarders, have limited power in deciding which stevedore a vessel calls at, particularly given that some shipping lines have entered into mid-term agreements with stevedores.

Introducing surcharges on transport operators is clearly unfair as there are no means of negotiation or parallel service agreements. Furthermore, transport operators are understandably now introducing a surcharge to administer the stevedore surcharge. The net result is that cascading costs are being passed down the supply chain.

The Australian Peak Shippers Association (APSA), Freight & Trade Alliance (FTA) and the Container Transport Alliance of Australia (CTAA) have led the case to the Australian Competition and Consumer Commission (ACCC) requesting a formal investigation of the DP World charging regime. We will now give the ACCC the latest on Patrick to add to their deliberations.

We also note and commend the action by Road Freight New South Wales in bringing the matter to the attention of the NSW state government. We trust that other trade bodies will also use their influence to address the unfair charging regime rather giving tacit support to the stevedores.  

The position from APSA and FTA remains that stevedores should either absorb operating costs or pass these onto their commercial client, being the shipping line. Should the shipping line then opt to pass on this cost, then that that can be negotiated on a commercial basis between themselves and their client importer, exporter or freight forwarder.

Perhaps the best and simplest outcome would be for the regulators to somehow enforce this model. If this could be achieved, then they could leave the rest to market forces to sort out pricing.

Parliament to review GST reforms on low value goods

We understand that the Treasury Laws Amendment (GST Low Value Goods) Bill will be presented to the House today (Tuesday, 13 June 2017) with the potential that it will then proceed to the Senate as early as tomorrow.

The Integrated Cargo System (ICS) will be unavailable for an extended period from 23:00 AEST tonight until 04:00 AEST tomorrow, Wednesday 14 June 2017 and is necessary to promote the "GST on Low Value Goods" release – refer HERE for the official ICS notes.

 
DIBP have no choice but to implement the changes to the ICS in preparation for a 1 July 2017. In the likely event that there is a delay to implementation (or full review espoused by the opposition). the Department of Immigration and Border Protection (DIBP) simply do not "flick the switch" to activate the ICS changes leaving everything as is with business as normal.

Freight & Trade Alliance (FTA) have liaised iwth DIBP, Australian Taxation Office and Treasury officials about compliance measures in the unlikely event of a 1 July 2017 implementation. Should this be the outcome FTA will disseminate further detail.

 

While it is possible that the legislation and systems changes could progress on 1 July 2017, the legislative delay is lending itself to a likely alignment to the Senate Economics Legislation Committee recommendation for a 1 July 2018 implementation.
 
FTA continues to advocate for an appropriate delay as a part of ongoing liaison with key government and industry stakeholders on this important reform.

IATA Global Passenger Survey

The IATA Global Passenger Survey is aimed to give an independent, in depth and objective snapshot of the views of air travellers from around the world into what they want, how they behave, why they make choices and on what they spend their money.
 
The survey assists in identifying the preferences of air travellers from the point of travel browsing to when they collect their bags at their final destination. The survey helps airlines and industry understand consumer priorities and preferences when travelling by Air - survey is available HERE 

Final count down to 1 July 2017 - airfreight to the USA


The low number of Known Consignors and off-airport RACAs with EACE notices are relatively low meaning that we have left a heavy reliance on our CTOs to complete the security task.

Freight forwarders have clearly done the sums and have decided not to invest in technology, systems, staff training and revised processes to obtain an EACE notice. We understand that third parties have developed commercial solutions which may assist in the cargo screening process and may go some way to alleviate the CTO workload.

Known Consignor Processing

From an exporters perspective it is now too late to take control of your destiny for the 1 July implementation. OTS advised that becoming a Known Consignor will take time with the length of processing dependant on the quality of the application. It is also a requirement that at least one staff member has Aviation Security Identification Card (ASIC), this alone takes several weeks to process ... read more

Approved Arrangement fee - twice in one finacial year !


As if there was not enough grief surrpounding the $2900 Approved Arrangement fee, we have had many members complaining that that they must now pay the fee for a second time in the same financial year.

Freight & Trade Alliance (FTA) has again followed up with the Department of Agriculture and Water Resources and received an explanation that the last invoice was issued late (hence falling into the 2016/2017 financial year) and reiterating that current invoices are to be paid before 30 June in advance of the Approved Arrangement renewal (and yes, that makes it two payments in the current financial year).
 
FTA is still advocacting for reform and are meeting with Departmental executives in Canberra on 19 June 2017.

In the interim, the only minor reprieve available is that the Department has agreed to accept part payments and have suggested that requests be made to the email address shown on the invoice.
