DPWA Infrastrcture Surcharge Implementation

The Australian Peak Shippers Association (APSA) and Freight & Trade Alliance (FTA) approached the Australian Competition and Consumer Commission (ACCC) and DP World Australia (DPWA) again on Thursday 13 April 2017 in terms of the Infrastructure Surcharge.
 
While appreciating that DPWA met an earlier request from APSA and FTA to move away from the original implementation date of 3 April 2017, DPWA denied a request for a further delay pending the ACCC deliberations. As a result, the new fees as outlined in our notice from 16 March 2017 came into force yesterday (17 April 2017) in Melbourne and Sydney.  
 
While waiting with keen interest on the outcomes of the ACCC deliberations, FTA and APSA are continuing to work with affected stakeholders to prevent this as being an acceptable precedent.
 

There is absolutely no suggestion of collusion among Australian stevedores, however history has shown that they tend to follow the leader. If DPWA can successfully weather this storm, it is highly likely that the others will follow, minimising any remaining opportunity for market forces to influence price, leaving industry with the legacy of a non-contestable cost recovery regime.

Michael Growder, Free Trade Agreement Division, Department of Foreign Affairs and Trade

Michael Growder is currently Assistant Secretary in DFAT's Free Trade Agreement Division. Michael has been posted to China and Vietnam during his time at DFAT, was part of the negotiating teams working on the China, Japan and Korea FTAs, and has also written published reports on Australian commercial opportunities in India and China. Prior to DFAT, Michael worked at the Reserve Bank of Australia.

Sally Phillips, Manager, Strategic Engagement, FTA Program, Austrade

Sally has 20 years of professional experience dealing with Japan in both corporate and government roles and has spent over 12 years living in a number of Japan's major cities and regions. Most recently Sally was in Tokyo where she was Counsellor (Commercial) and Trade Commissioner at the Australian Embassy.  With the signing of the Trade Agreements with South Korea, Japan and China, from July 2015, Sally has taken on Austrade's Strategic Engagement of the FTA program.

Victorian company loses customs depot licence for repeated breaches

Freight & Trade Alliance (FTA) has received advice that the Australian Border Force (ABF) has cancelled the depot licence of a Victorian company for repeatedly breaching its licence conditions. including:

  • unpacking, moving and storing goods outside of the licenced area

  • failing to keep goods in a separate and distinct area from goods not subject to customs control

  • failing to provide commercial records relating to goods received into the depot

  • failing to maintain a depot log book providing details of people entering the licensed area

  • failing to maintain adequate fencing and gates

  • failing to implement and maintain an effective accounting system.

ABF officers served the company with a Notice of Intended Cancellation and Suspension of the Customs Depot Licence pursuant to s77V of the Customs Act 1901. This meant the depot licence was immediately suspended with full cancellation taking effect on Tuesday, 11 April 2017.
