DP World Australia (DPWA) Infrastructure Surcharge Update

 
FTA and APSA are conscious of the 17 April "go live" date for the DPWA Infrastructure Surcharge increase at the Port of Melbourne and the introduction of the charge at the Port of Botany. We have asked for an urgent update from the ACCC based on their investigations to date. 

We will provide members with more information as it emerges.
FTA/APSA acknowledges DPWA for their recent engagement but formally challenges this method of revenue raising as unfair and has sought the immediate support and intervention of the ACCC in this matter.
 
FTA/APSA has expressed concerns that if this method of revenue raising is permitted by the ACCC and other regulators, then we will see further increases in the future, including the introduction of similar charges by rival stevedores. Landside stakeholders have little to no opportunity to negotiate or exercise their market power in response to these increases and therefore a dangerous precedent is being set for all actors in the international supply chain.
 
FTA & APSA continue to provide evidence to the ACCC of the "detrimental effect" of these charges and if you would like to share how this charge will impact your business please email us at secretariat@auspsa.com

APSA continues to Grow!

The Australian Peak Shippers Association (APSA) is going through a major growth spurt and is proud to welcome new members, representing some of Australia's largest shippers, including Emerald Grain, Mondelez and Casella Family Brands. APSA would like to particularly thank Casella and their Head of Distribution, Mr. Sam McLeod, for their hospitality in hosting the APSA secretariat in Griffith last week, giving a tour of their impressive production and export operations.
 
With both NSW Ports and the Port of Melbourne contesting the Riverina trade, and regional volumes increasing, Griffith feels more and more like the centre of the universe.
 
Shippers are reporting major shifts in the market, with an increase in infrastructure fees, a spike in surcharges, consolidation of shipping lines, serious equipment shortages and the perception that space on the berth is tightening. In this environment, APSA has never played a more vital role.
 
APSA currently represents the top containerised shippers by volume including Visy, Murray-Goulburn, Bega, Cargill, Barrett Burston and others, representing in excess of 500,000 TEU on export annually. APSA Board consulted on future Free Trade Agreements under negotiation

 

On Wednesday 5 April 2017, the board of the Australian Peak Shippers Association (APSA) were given an exclusive update by the Department of Foreign Affairs and Trade executives on the progress of Free Trade Agreements currently under negotiation:
 

  • Indonesia-Australia Comprehensive Economic Partnership Agreement (IA-CEPA)

  • Regional Comprehensive Economic Partnership (RCEP)

  • Pacific Agreement on Closer Economic Relations-Plus (PACER-Plus)

  • Australia-India Comprehensive Economic Cooperation Agreement (CECA)

  • Environmental Goods Agreement (EGA); Trade in Services Agreement (TiSA)

 
The board were also given a glimpse into the scoping of major prospective future agreements including the European Union (scoping study underway), the United Kingdom (Joint Working Group Established) and the potential for a future trade agreement with Latin America.

Uncertainty on import tax reforms as we near 1 July "go live"


The internet trade sector faces mayhem with the inquiry on GST collection on low value goods further shortening the implementation timeframe.

On 23 March 2017, the Senate referred the provisions of the Treasury Laws Amendment (GST Low Value Goods) Bill 2017  to the Senate Economics Legislation Committee for inquiry and report. 
 
The bill proposes to amend i) A New Tax System (Goods and Services Tax) Act 1999 to ensure that goods and services tax is payable on certain supplies of low value goods that are purchased by consumers and are imported into Australia; and ii) Taxation Administration Act 1953 (TAA) to broaden administrative penalties for making false or misleading statements.

The Committee is due to report to the Senate by 9 May 2017.

Freight & Trade Alliance (FTA), as members of the Single Window Working Group, have been advised that the Domestic Single Window Study and the International Single Window Study reports are now available … read more

In 2016, the Department of Immigration and Border Protection, Australian Business Register Program and the Department of Foreign Affairs and Trade formed a partnership to undertake two research studies, the Domestic Single Window Study and the International Single Window Study. These studies will assist the Australian Government to determine the next steps for Australian trade, import/export processes and regional trade cooperation.

The Australian Government is committed to ongoing industry engagement to advance trade facilitation initiatives. Further studies to identify opportunities to streamline regulatory reporting for businesses, such as the Digitising Origin Data Study with consultants KPMG, will continue in 2017.

Changes to Timber and Timber Product Import Conditions

The Department of Agriculture and Water Resources has released the long anticipated Import Industry Notice No. 34-2017 advising of changes to timber and timber product import conditions ... login required
 
Following up on member concerns, Freight & Trade Alliance (FTA) questioned the requirement for an additional manufacturers/suppliers declaration for wooden manufactured articles when goods were treated and a valid fumigation/treatment certificate was produced.
 
Unfortunately, the department has insisted on the additional document  in addition to any valid treatment certificate.
 
Another concern from members was the wording in the Highly Processed Wooden Articles specifically for items under 4mm in width but not in height – according to the department representative, the policy has always been that release of items will only be done on evidence that the goods are under 4mm in height AND width.
 
FTA explained our members' understanding that items under 4mm in width/diameter were cleared without impediment as long as the height was under 200mm i.e. toothpicks, wooden skewers etc.
 
Clearly, there has been a change of policy and/or practice by the department which basically makes the under 4mm rule void.
 
We suggest that members advise their clients and overseas counterparts of the new requirements in lead up to the commencement on 17 April 2017.

ASG Plant Export Service Standard Update

The Assessment Service Group has been maintaining its air freight service standard of one business day. We continue to have had difficulty maintaining the three business day service standard for sea-freight shipments. At 2 pm today, 04/04/17, we are approximately one day outside the 3 business day sea freight service standard.
 
As previously detailed,  additional staff have received training in recent weeks and this has increased capacity to address the high workload. Unfortunately we are now in the middle of the table grape export season which has meant that although we haven't slipped significantly further with our document turn around, we are still not meeting our standard. We will have some increased resourcing in the next fortnight with experienced staff returning from leave and have some confidence that this will soon put us in a better condition and improve document turn around times.
