Licensing Review draft recommendations presented to the Comptroller-General of Customs

A call for de-regulation of individual customs brokers by one industry sector appears to have been brushed aside with the Department of Immigration and Border Protection appropriately retaining licensing for this important trade profession.

In fact the department's principal recommendation is that licensing be retained for customs brokers, depots and warehouses with the remaining recommendations looking to strengthen and streamline procedures ... read more

Stephen Skehill has been the Chair of the National Customs Broker Licensing Advisory Committee for the last 7 years and thus has a valuable insight into not only issues arising from applications for new broker licences but also broker default that may call into question whether an existing licence should be revoked.

Stephen will present at our upcoming CPD & CBC – Border and Biosecurity Compliance Program events in Melbourne (3 May 2017), Sydney (17 May 2017) and Brisbane (31 May 2017) examining outcomes from the licensing review, management considerations and essential tips for licence applicants

Managing your Cyber Risk

A disgruntled ex-subcontractor hacked the forwarder's network multiple times with the intention of disrupting business operations.

As a result of the attacks, the forwarder's network was down for 21 days. This included the forwarder's cargo/order tracking software and web based warehouse management system, which was severely compromised. This resulted in the forwarder's customers having no on line visibility which caused stress and anxiety for the forwarder and their customers... read more

Changes to improve TTT at MCS Cooks River Intermodal Terminal

MCS Cooks River Terminal is consistently experiencing high volume truck movement during a concentrated peak period, reporting that 85% of carriers arrive off window for dehires and pickups.

MCS are committed to service industry without redirection and claim that they are by no means experiencing a capacity issue, rather a peak period throughput issue.

Constant communication with industry to utilise off peak times and Saturdays has not been met a corresponding uptake.

As outlined in their industry notice, effective Tuesday 18 April 2017, MCS will require carriers to more rigidly manage their "on time arrivals" against timeslots booked ... login required

Why the wheelie bin classification case is not a load of rubbish

A recent Federal Court case held that wheels for a wheelie bin should not be classified as part of a vehicle.  The layman will say that this was stating the obvious, a wheelie bin is clearly not a vehicle.

Customs brokers will see this as another case in a long line of odd classification arguments.  In recent years we have seen Customs try to argue that wontons are pasta and that celling fans should be classified as lights.

Many of these cases seem to have little relevance beyond the goods the subject of the decision.  However, the wheelie bin case has valuable lessons for all involved in classifying goods ... read more

GST Low Vale Goods - formal inquiry established

The Selections of Bills Committee  has referred the Treasury Laws Amendment (GST Low Value Goods) Bill 2017 to the Senate Economics Legislation Committee for a formal inquiry.

Whilst we see merit in the inquiry and the above terms of reference, this will leave industry with an even shorter window to prepare for implementation between the eventual passing of the Bill (with any amendments) and a 1 July 2017 "go live" currently being pursued by the Federal Government ... read more
