SUPPLY CHAIN REFORMS

DPWA Infrastructure Surcharge

 

The Australian Peak Shippers Association (APSA), Freight & Trade Alliance( FTA) and DP World Australia (DPWA) executives met last week in respect to the Melbourne and Sydney Infrastructure Surcharge. In open and frank discussions, APSA / FTAexpressed concerns about i) lack of consultation in deriving the cost recovery policy ii) the methodology of cost recovery iii) the quantum of the cost recovery iv) the inequity of the cost recovery.

Since our last industry notice we have received correspondence from the Global Shippers Forum in London supporting our position.
 
On a positive note, DPWA has given a commitment to engage with APSA / FTA to explore alternative cost recovery and service level models. In parallel, APSA and FTA are meeting today with the Australian Competition & Consumer Commission (ACCC).
 
We will keep members up to date with developments.

Acquisition of Hamburg Sud by Maersk Line

 

In a formal submission to the Australian Competition and Consumer Commission (ACCC), the Australian Peak Shippers Association (APSA) identified three key areas of concern:

  • the participation of Maersk and Hamburg Sud in separate Vessel Sharing Agreements, Discussion Agreements and other agreements that have been registered under Part X of the Competition and Consumer Act;

  • the predominance of both Maersk and Hamburg Sud in the Australian reefer trade;

  • other services where an acquisition may constitute a significant lessening of competition.

APSA recommended: 

  • the ACCC conduct further research on the impact on existing Conferences/Discussion Agreements before the acquisition is allowed to take place; and

  • should the acquisition be accepted, that the ACCC support negotiations of basic guarantees for Australian exporters, in respect to the retention of services and service levels.

National Freight & Supply Chain Strategy

 
The Minister for Infrastructure and Transport, the Hon. Darren Chester, has announced the Terms of Reference for the Federal Inquiry into Freight and Supply Chain Priorities. The Inquiry is due to commence this year and is to conclude in early 2018.
 
Australian Peak Shippers Association (APSA) and Freight & Trade Alliance (FTA) representatives met with the Minister last year when the Inquiry was first announced and would like to congratulate the Minister and the Department of Infrastructure on leadership in this area.
 
APSA and FTA would also like to congratulate the senior industry panellists on their appointment: 

  • Marika Calfas, Chief Executive Officer, NSW Ports 

  • Maurice James, Managing Director, Qube Holdings

  • Nicole Lockwood, Chair, Freight and Logistics Council of Western Australia

The Federal Government is examining the concept of introducing a United States (US) style Department of Homeland Security, bringing together the Department of Immigration and Border Protection (DIBP), its enforcement arm being the Australian Border Force (ABF), the Australian Federal Police (AFP) and the Australian Security Intelligence Organisation (ASIO).

FTA member scenarios 


Freight & Trade Alliance (FTA) representatives engaged again yesterday with Treasury, ATO and DIBP representatives. The Bill remains in the House of Representatives and is likely to be read when Senate / Parliament sits again in the last 2 weeks of March 2017.
 

The ATO has agreed to review specific scenarios raised by FTA members (and their clients) and to provide advice on how to comply with the new procedures as outlined in the Bill, in particular whether a company may or may not be a "re-deliverer".

Asbestos CPQ in motor vehicles

Freight & Trade Alliance (FTA) and the Australian International Movers Association (AIMA) have made a submission to the ABF in relation to the implementation of asbestos procedures on motor vehicle imports effective 6 March 2017 (change in the Community Protection Question / Profile on import declarations).
 
Concerns include: 

  • whilst owners they may be able to gain certification from the vehicle manufacturer, difficulty will exist in identifying the 'after-market' replacement parts which may have been installed in vehicles and could hold asbestos; 

  • the quantum of the potential penalties for what may be an innocent declaration;

  • the potential backlog of vehicles in depot warehouses awaiting some kind of inspection at an approved NATA facility who will no doubt be inundated with requests for inspections; and

  • the cost of NATA facility inspections on clients importing vehicles in personal effects shipments.

Members have raised concerns about the immediate impact of this procedure on vehicles recently arrived or in transit as neither owners of personal effects / cars or AIMA members had adequate knowledge of this requirement.
 
FTA and AIMA have requested that the ABF temporarily suspend the CPQ to allow for appropriate industry consultation and co-design of an implementation program - we will keep members up to date on developments.

TODAY - Members' Open Forum - Trade Facilitation


The Department of Immigration and Border Protection has commissioned Deloitte Access Economics to analyse the costs that trade facilitation processes within its control impose on businesses seeking to import and export products to and from Australia.

As part of the project, Deloitte Access Economics will be engaging with the Freight & Trade Alliance (FTA) and Australian Peak Shippers Association (APSA) in Canberra on 16 March 2017 to identify:

  • the main barriers to trade associated with trade facilitation processes;

  • the size of financial and time costs associated with trade facilitation processes; and

  • any potential areas in which trade facilitation processes can be improved
