PATRICK REJECTS 'PRICE GOUGING' ALLEGATIONS

The Australian Financial Review last week gave Patrick stevedoring extensive exposure supporting its position against the protected industrial action imposed by the Maritime Union of Australia (MUA). FTA / APSA (and members) all contributed significant comment highlighting the operational and economic impacts of the disruption to business continuity.

The AFR did how however provide the MUA with a free kick in the article Patrick rejects 'price gouging' allegations .

Stevedore Patrick says the money it raises from charging importers and exporters fees to move containers in and out of its ports does not fully offset the money it invests in improving infrastructure, as wharfies prepare to strike in Sydney and Melbourne over pay and conditions.

The Maritime Workers' Union has claimed that the surge in Patrick's annual profits was obtained by "price gouging" through terminal access charges and other shipping fees, arguing it had raised the cost of goods for Australians.

Patrick delivered an annual net profit of $25.6 million in the year to June 30, reversing a $15.7 million loss in the year earlier period.

In return for the use of our collated data on Terminal Access Charges, we are grateful to the AFR for showcasing our advocacy and need for reform in the charging regime.

The Freight and Trade Alliance, which represents importers and exporters, has asked the National Transport Commission to consider regulation to force stevedores to recover infrastructure costs from shipping lines, rather than from transport operators.

"It is an abuse of market power and unreasonable to impose a charge on a party that has no say; cannot negotiate the charge and cannot go elsewhere to receive and deliver containers," the FTA said in its submission to the commission, which is developing national guidelines on charges.

REGULATION IS REQUIRED TO REPLACE THE INSANITY OF A VOLUNTARY REGIME

Last week, FTA/APSA were briefed by DP World executive in terms of a further increase in Terminal Access Charges and associated fees, effective 1 January 2022 – formal announcement released today and available HERE (Refer 'Public Tariff Schedule)
 
In line with emerging protocols, DPWA has given notice in line with prescribed time frames in what we now expect will be a once per annum adjustment in their tariff.

FTA SUBMISSION - GOODS AND SERVICES TAX (REVIEW OF LOW VALUE IMPORTED GOODS)

Incorporating extensive member feedback from freight forwarders, customs brokers and the E-Commerce Reference Group (Alibaba, eBay and Amazon), Freight & Trade Alliance (FTA) last week completed a submission to the  Goods and Services Tax - Review of Low Value Imported Goods.

The submission highlighted the LVIG regime is being undermined by enabling businesses who sell to Australia via particular platforms to charge 10% less than via electronic distribution platforms (EDPs) or other domestic competitors. In effect, this encourages consumers to shop on less trusted websites which do not provide guarantees on purchases, reduces government tax revenue and most importantly reduces the competitiveness of Australian retail.
 
As a general tax compliance, integrity and transparency measure, FTA also recommended the ATO document and report on those EDPs required to collect and remit on an annual basis. As we are likely to see new entrants into the Australian market in the coming years, this would assist in demonstrating these entities are compliant with the rules.

REPORTING SUSPICIOUS BEHAVOIUR TO THE ACCC

As outlined in our report into the official investigation into international containerised shipping practices, the ACCC has requested feedback on suspicious behaviour that may indicate anti-competitive behaviour. Reports can be provided to the ACCC, including anonymously if preferred, via https://www.accc.gov.au/contact-us/contact-the-accc

FTA and APSA members of any size can use the 'small business' contact point, selecting the option corresponding on number of  employees. The ACCC find that larger businesses often write rather than use their website contact form. FTA and APSA are assured that all contacts are centrally reviewed by the ACCC regardless of how they are made.
 
On the ACCC website form there is a tick box for if the party wishes to remain anonymous, however to assist with the ACCC assessment of the issue, it is preferred if members could still provide a name (even if only a first name) and note what type of party is making the complaint – eg. freight forwarder, importer/exporter etc. Obviously if members choose to remain anonymous, it can make it difficult for the ACCC if they need to seek further information to make an assessment of the alleged conduct or to respond to members enquiries.
URGENT ACTIONS TO PROTECT AGAINST KHAPRA BEETLE

OFFICER IDENTIFICATION ON ISSUED DIRECTIONS

The Department of Agriculture, Water and the Environment will be delivering a change on Saturday 2 October 2021 to the Agriculture Import Management System (AIMS) which will remove the Biosecurity Officer name from issued directions. Currently, directions issued by the department contain the name of the Biosecurity Officer who issued the direction. In future, directions will be issued with a unique reference code and the Biosecurity Officer names will no longer be available publicly - READ MORE
