ACFS CEO Arthur Tzaneros gives a summary of the last six months of trading and developments within the business.

The interview addresses the challenges faced by the containerised supply chain industry, whilst also covering updates with enterprise agreements between port operators and the MUA, whilst also touching on ACFS industrial updates with the TWU.

Arthur acknowledges the great work and effort by ACFS employees around the country, shares some news on the new acquisitions and partnerships, new sites (including site expansions), equipment and technology projects that have taken place throughout the year, whilst also recognising ACFS chairman Terry Tzaneros's recent induction into the industry hall of fame.

WEEK IN REVIEW
WEEK 31 - GLOBAL FREIGHT INTELLIGENCE 

While the data provided and geography lesson is interesting, the overall theme in the Shipping Australia commentary "Fact check: Australia benefits from plentiful container shipping" is in direct contrast to evidence supplied by FTA/APSA members highling that shipping capacity remains a major threat to the growth of the Australian economy.

Limited supply and significant demand is driving up freight rates to record high levels with a spate of surcharges thrown on top, many attributable to congestion caused at ports both locally and overseas.

Rubbing salt into the wounds are the exorbitant container detention penalties that were charged in the last quarter of 2020 when many Australian empty container parks were at capacity. Forwarders, importers and transport operators are still debating these penalties, in some cases tallying to hundreds of thousands of dollars, causing significant tension amongst supply chain participants. Adding to the angst, it is becoming increasingly evident some local shipping line representatives are forced to administer unfair charging practices as directed from international head offices.

The price for moving cargo is one thing but some desperate exporters and importers are struggling to find capacity at any cost, some waiting weeks before securing bookings only to see blank sailings and cargo being bumped to future voyages.

This is a particular concern at a time when some shipping lines are at the same time overtly promoting international loading priority of freight space in association with the uptake of services including customs / biosecurity clearance and inland transportation. While there is nothing stopping vertical integration of services, FTA/APSA will maintain a focus on potential exclusive dealings to ensure that shipping line end-to-end logistics service offerings do not lessen competition.

SHIPPING AND AIRFREIGHT CAPACITY CONSTRAINTS

FTA / APSA CALL FOR A SHIPPING REVIEW & FEDERAL MARITIME REGULATOR
FTA / APSA joined industry colleagues in a meeting with The Hon Dan Tehan (Minister for Trade, Tourism and Investment) on Friday 30 July 2021 and separately engaged with a senior ministerial advisor that same evening. The primary focus of the FTA / APSA advocacy was to follow up on our meeting on 2 June 2021 (report available HERE) noting in recent weeks the further deterioration in shipping capacity and an associated rapid escalation in shipping costs.  
 
In formal correspondence sent to the Minister today, 2 August 2021, FTA and APSA again re-stated its call for the creation of a new federal regulator, along the lines of the US Federal Maritime Commission (FMC), to facilitate open and competitive international trade while safeguarding the interests of Australian shippers (exporters, importers and freight forwarders) - READ MORE
BREAKING NEWS: US COMPANY SUES 'COLLUSIVE' OCEAN CARRIERS, ALLEGING PRICE MANIPULATION
According to JOC, a Pennsylvania-based home goods importer filed a formal complaint with US maritime regulators, accusing two international shipping lines of working together to violate service contracts to further take advantage of record trans-Pacific container spot rates and premiums.

The complaint will become a highly visible test of the idea that carriers will retaliate against shippers who publicly complain to the FMC, action that is explicitly barred by US shipping law but which shippers fear nonetheless. Speaking for its major container line members during a House subcommittee hearing on June 15, World Shipping Council president and CEO John Butler rejected accusations that more shippers aren't filing complaints due to fear of retaliation from carriers. "I categorically reject the idea that shippers are being threatened with retaliation for bringing complaints," Butler said.  READ MORE

The ACCC has lodged an appeal against the Federal Court's decision to dismiss the ACCC's proceedings against NSW Ports Operations Hold Co Pty Ltd and its subsidiaries Port Botany Operations Pty Ltd and Port Kembla Operations Pty Ltd (together, NSW Ports) - READ MORE
STATEMENT FROM CRAIG CARMODY CEO PORT OF NEWCASTLE
Port of Newcastle welcomes the ACCC's decision to appeal the ACCC v NSW Ports case following the Federal Court's recent judgment. 
Development of another container terminal in NSW, even whilst Port Botany still has capacity, would provide a viable alternative and more cost-effective export routes for regional NSW farmers and manufacturers. Such competition would increase regional NSW global competitiveness and allow these suppliers to avoid congested supply chains. Port of Newcastle is confident that it has the ability to compete in the same market as Port Botany. Port of Newcastle continues to monitor the progress of the Federal Court proceedings with a keen interest and awaits the outcome of the appeal.

NEW REGULATORY PRACTICE STATEMENT
The Department of Agriculture, Water and the Environment has published a new Regulatory Practice Statement outlining the department's approach to delivering better practice regulation, and a framework to support an improved regulatory capability and culture for the organisation.
 
The statement will also be supported by a Compliance Policy (currently in development) that will outline the department's approach to managing compliance and how they respond to non-compliance.
