IFAM EXTENSION PROVIDED - WILL IT BE LONG ENOUGH?
While we have received welcome relief with the announcement that IFAM will continue until the end of September 2021, APSA and FTA are continuing engagement with National Farmers Federation (NFF), AgriFutures and KPMG to advocate for further IFAM funding until our international border are opened again (whenever that may be).

In parallel our focus continues for a mainstream media and social media campaign to support this approach and assist in 'changing the narrative' to support the view of business that international borders must be opened as soon as acceptable COVID-19 risk mitigation strategies are available. While tourism and education would be the obvious beneficiaries of this approach, little is known publicly about the impacts on trade caused by the significant reduction of passenger aircraft servicing Australia (noting that 80% of international air cargo has traditionally been carried in the passenger aircraft into and out of Australia).

FTA and APSA will continue to engage with key stakeholders across government and industry in a collaborative effort to address this matter that is not only impacting on exporters, importers and the air cargo sector, but has national significance to the wider Australian economy.
GLOBAL SHIPPERS FORUM - SHIPPERS PAYING RECORD RATES FOR DETERIORATING SERVICE
APSA and FTA have board representation on the Global Shippers Forum (GSF) and is also a member on the Container Shipping Market Review Panel. In this capacity, we are privy to the latest quarterly review of the container shipping market released by MDS Transmodal and the GSF. The eight key performance indicators correlate with media reports that importers and exporters around the world are paying record high shipping rates and are experiencing appalling levels of service reliability,

PART X REVIEW
We are totally reliant on foreign owned international shipping lines to continue servicing Australian trade and therefore there is no questioning that they must be incentivised to do so on a profitable basis. APSA and FTA are calling for regulation to: 1) ensure vessel sharing consortia can continue with qualified exemption from normal competition rules administered in Australian commerce 2) monitor the appropriateness of shipping line (and contracted stevedore / empty container park) surcharges, fees and penalties.
 
In this context, Part X of the Consumer & Competition Act 2010 currently allows for shipping lines to be given partial and conditional exemptions from cartel conduct and contracts that restrict dealings or affect competition and exclusive dealings.
 
APSA is the designated peak shipper body as defined in the Act with FTA administering the Part X compliance in a contracted Secretariat role to the association and reporting to its Committee of Management. In a meeting with the Australian Competition and Consumer Commission (ACCC) last week, APSA / FTA reiterated that the events over the last 12 months have re-affirmed our position that Part X does not adequately protect the interests of Australian exporters and importers and to that end we see merit in a replacement block exemption regime.

PRODUCTIVITY COMMISSION STUDY ON VULNERABLE SUPPLY CHAINS
We have received advice that the timeline for this study has been extended to July 2021 to allow more time for consultation.

Submissions and comments are invited to inform the final report.  An interim report, to be released in late March, will focus on supply chain vulnerabilities from Australia's role as an importer. Participants are invited to examine the report and comment on it by written submission by Friday 30 April 2021.
The Commission is also looking to examine supply chain vulnerabilities from Australia's role as an exporter. The Commission is particularly interested in understanding:
  • how firms manage and respond to disruptions in export market conditions and access
  • the impact that these disruptions can have, including in regional areas.
Comments and submissions on these issues are also invited by Friday 30 April 2021.

WITHDRAWAL OF PORT BOTANY CONGESTION SURCHARGES

Following our recent commentary  calling for an end to the Port Botany Congestion Surcharges, we are delighted to report that multiple shipping lines (Hamburg Sud, Maersk, Hapag Lloyd, ANL CMA CGM, MSC, Pacific International Lines & TS Lines) have responded acknowledging the improved operational conditions and termination of the surcharge. We thank these lines and others who we have been in contact with over the last two weeks for their open and positive engagement.

DP WORLD - ANOTHER INCREASE IN TERMINAL ACCESS CHARGES

DP World today have announced a further round of increases to Terminal Access Charges following those that took effect nationally on 1 January 2021. Effective 1 May 2021, DP World will administer further increases in both export and import containers (Sydney, Melbourne and Brisbane) - refer HERE.

STEVEDORE TERMINAL ACCESS CHARGES

Following our member update from 26 November 2020 and the 14th Infrastructure and Transport Ministers Meeting Communique, the National Transport Commission (NTC) will lead reform and the development of 'voluntary national guidelines' to apply to stevedore infrastructure and access charges (both their introduction and increase) at Australia's container ports. We made contact with the project lead who stated that NTC has not yet reached the industry consultation stage; however, this will soon ramp up to ensure that a final report can be provided by November 2021.

In the interim, FTA and APSA representatives will be meeting this week with the Hon. Melissa Horne (Victorian Minister for Ports and Freight) and executives from Freight Victoria with a focus on their lead initiative for a Voluntary Port of Melbourne Performance Model (VPPM).
