IMPORTS OF UNDENATURED ETHYL ALCOHOL OF AN ABV OF 80% OR GREATER FOR USE IN MANUFACTURING HAND SANITISER IN AUSTRALIA

Imported undenatured ethyl alcohol that is imported with an alcohol by volume (ABV) content of 80% or greater, and that is for use in manufacturing hand sanitiser in Australia, is subject to customs duty when imported of 5% plus $86.90 per litre of alcohol. While a Free Trade Agreement may remove the 5% substantive rate, it does not remove the $86.90/LAL EEG rate. There is no applicable TCO for the goods as imported and little chance of obtaining one as the good is manufactured in Australia. As you are aware, TCOs cannot specify end-use, but bylaws are able to do so. FTA (Freight & Trade Alliance) have approached ABF to request consideration that a new bylaw be made providing that such goods when imported for use in manufacturing hand sanitiser during the Covid-19 pandemic (or such other emergencies as may be decreed) but have not at this time been successful. ... read more

27.4.2020 DCN - MINISTER DISAPPOINTED BY HIGHER STEVEDORE FEES

"The timing of this decision was particularly disappointing, coming at a time when Victoria is experiencing unprecedented pressures and disruptions across the port supply chain as a result of the COVID-19 crisis," Minister Horne said.

"This is a time when everyone should be pulling together to keep businesses open, people in jobs and keep goods moving to ensure essential services can continue to operate." ... read more

24.4.2020  MHD - MINISTER SUPPORTS ALLIANCE'S CONCERNS OF INCREASED PORT FEES

Melissa Horne, Minister for Ports and Freight has written to the Freight and Trade Alliance (FTA) following its advocacy against DP World increasing access charges scheduled for Melbourne and Brisbane.

According to the correspondence seen by MHD,  Melissa Horne said in an email to Paul Zalai, FTA director on Thursday April 23 that she was "disappointed to learn that DP World is to increase its access charges again for importers at the Port of Melbourne for the second time in four months at short notice"... read more

21.4.2020 DCN - CONSTANCE CALLS FOR RESTRAINT ON STEVEDORING CHARGES

FTA director Paul Zalai was heartened by the report but said it was time for action.

20.4.2020 ATN - PRESSURE MOUNTS ON STEVEDORES OVER CONTAINER ACCESS CHARGING

FTA/APSA points out that states other than NSW would need new legislation to allow for control on access charging but that provision already exists in NSW.

FTA/APSA says it received advice from Freight Victoria CEO Praveen Reddy last week that we will receive "a formal correspondence outlining the Victorian government's formal response" to the Deloitte Access Economics report on port charges ... read more

NEW FREE TRADE AGREEMENTS ARE A PLUS FOR IMPORTERS AND EXPORTERS – BUT COMPLIANCE LIES IN THE FINE PRINT

In the first half of 2020 three separate new free trade agreements (FTA) will commence between Australia and each of Hong Kong, Peru and, most importers, the result will generally be across the board duty free entry of goods from these
countries. For exporters, the duty reduction will depend on the particular product. However, the vast majority of goods will be duty free.
However, duty reductions under free trade agreements do not occur automatically and it is truly a case of the "the devil lies in the detail". However, what makes use of FTAs particularly difficult is that the detail is different for each FTA. In this article we
will demonstrate why importers/exporters cannot assume that the rules for one FTA apply to another meaning that customs compliance must be an integral part of your strategy regarding use of FTAs.

Tariff classification and TCOs – updates from the High Court and Full Federal Court

Over the past two months, two important Court judgements have been delivered that impact customs broker compliance in dealing with tariff classification and TCO applications. 
  • High Court Pharm-A-Care decision – this case concerned the classification of vita-gummies – food versus medicament.  However, the case has wider implications and provides guidance on general classification principles.
  •  Full Federal Court Alstom TCO decision – this case considered whether for the purpose of assessing a TCO application, a manned train is substitutable for a driverless train.  The Full Federal Court decision is important for any customs broker that assists clients with TCO applications.
