DEFERRAL OF GST ON IMPORT CONSIGNMENTS
9 days remain to lodge a DGST application (as of today, 21 April 2020)

Freight & Trade Alliance (FTA) has been working closely over the past 3 weeks with the ATO on the benefits provided to importers under the current Deferred GST (DGST) scheme and the potential for further enhancement as a COVID19 relief measure.
 
While details of any enhanced arrangement are yet to be outlined and clearly require further government consideration, we urge our importer members to register NOW for DGST taking into consideration: 
  • the unique timing opportunity presented for existing quarterly reporters; and
  • to be "first-in" to take advantage of any enhanced COVID19 relief measure associated with the scheme.
NOTE: In the current economic crisis, the ATO confirmed receipt of significantly increased number applications for DGST registration. We understand that the ATO have significantly increased automated capabilities, that should process up to 500 DGST applications per day.
 
Current benefits of DGST

Importers registered for DGST are required to lodge their Business Activity Statement (BAS) monthly and electronically. Once approved, the import GST otherwise payable at the border is deferred until the 21st of the following month. That is, importers registered under DGST will defer the payment of GST on any importation occurring throughout the month of April, until the 21st May. The payment of GST on any importation occurring in the month of May, will be deferred until the 21st of June. And so on, every month.   

IMPORTANT: The ATO will allow importers 
to "opt in" for 3 months and then "opt out"

ATO - DEFINITION OF TURNOVER

In terms of the Cash Flow Boost scheme, it is noted that eligibility is linked to subsection 4(2) that operates to increase the aggregated turnover threshold for the definition of a small business entity for the purposes of sub-division 328-C of the Income Tax Assessment Act 1997 to $50 million.

FTA has sought a formal determination from the Australian Taxation Office Commissioner for a determination under sub-paragraph 5(1)(d)(ii) of the Act by exempting statutory import charges and international freight disbursements that are paid and recouped from freight forwarder and licensed customs brokerage customers (importers and exporters) - further detail will be disseminated to members today.

20.4.2020 ATN - PRESSURE MOUNTS ON STEVEDORES OVER CONTAINER ACCESS CHARGING

Freight & Trade Alliance/Australian Peak Shippers Association (APSA/FTA) sees the move as possibly opening the way for regulation of terminal access charges, also called 'infrastructure surcharges' if the Constance approach is again ignored .

"Events have transpired to be the catalyst required to fast-track the long awaited implementation of regulation to stop the use of Infrastructure Surcharges," FTA director Paul Zalai says.

"Our message to state governments is simple in what is shaping up to be an extended period of economic uncertainty 'please no more reports, the issues are obvious and we now need decisive action'."

FTA/APSA points out that states other than NSW would need new legislation to allow for control on access charging but that provision already exists in NSW.

17.4.2020 ATN - SHIFT IN IMPORT COMPLIANCE APPROACH AS CONTAINER CHAOS LOOMS

Now Freight and Trade Alliance/Australian Peak Shippers Association (FTA/APSA) is saying those bearing much of the brunt are withdrawing their exposure to risks as liquidity dries up.

"Customs brokers are no longer accepting the cash-flow imposition of making up front import statutory charge payments and recouping costs from importers on a disbursement basis," FTA director Paul Zalai says.

"The 'new normal' leaves importers to either make up front payments to customs brokers or to register via the Integrated Cargo System [ICS] to make direct EFT payments of import statutory charges.

"This is already generating early warning signs that containers may become stranded at our wharves, with importers struggling with insufficient cash flow to clear goods into home consumption." ... read more

Tariff classification and TCOs – updates from the High Court and Full Federal Court

Over the past two months, two important Court judgements have been delivered that impact customs broker compliance in dealing with tariff classification and TCO applications. 
  • High Court Pharm-A-Care decision – this case concerned the classification of vita-gummies – food versus medicament.  However, the case has wider implications and provides guidance on general classification principles.
  •  Full Federal Court Alstom TCO decision – this case considered whether for the purpose of assessing a TCO application, a manned train is substitutable for a driverless train.  The Full Federal Court decision is important for any customs broker that assists clients with TCO applications.
