DEFERRAL OF GST ON IMPORT CONSIGNMENTS
Freight & Trade Alliance (FTA) continues engagement with the Australian Taxation Office (ATO) who are considering options for importers to defer GST on import consignments. The likely solution will revolve around administration of the existing Deferred GST scheme. The ATO have automated processes meaning that applications can now be processed with 3 to 4 days. It is anticipated that the ATO can process up to 500 applications per day. Further details to be provided soon.

In parallel, FTA also continues its engagement with the Australian Border Force and Treasury in terms of potential deferral solutions for Duty and import Processing Charges.

THE AUSTRALIAN FINANCIAL REVIEW 8.4.2020 - AFR - IMPORTERS SEEK RELIEF FROM PORT CHARGES SQUEEZE

Consumer goods importers have asked the federal government to defer taxes and customs duties for at least six months to relieve a cash squeeze caused by COVID-19 and stop food, clothing and furniture being stockpiled at ports. 

"While state government and port corporations are currently contingency planning and examining staging sites as required to store containers in the event of supply chain failures, this will be a futile exercise if goods cannot be cleared from customs control into home consumption," Susan Danks, head of customs and regulatory compliance for the Freight & Trade Alliance (FTA), said in a letter to Treasury last week.

Companies that import goods into Australia say they can't afford to pay taxes and duties on time because of cash squeezes.

Importers must pay duty on goods brought into Australia, as well as goods and services taxes and an import-processing charge.

A medium-sized customs broker can pay about $5 million a month on behalf of importers to clear goods for home consumption, according to the FTA.

The industry group has met with the Australian Border Force and the Australian Taxation Office over the past week to discuss options for deferring taxes and duties. 

FTA director Paul Zalai told The Australian Financial Review the government agencies had been responsive, and that fast action was needed to alleviate potential congestion at ports as manufacturing resumed in China.

  •  Full Federal Court Alstom TCO decision – this case considered whether for the purpose of assessing a TCO application, a manned train is substitutable for a driverless train.  The Full Federal Court decision is important for any customs broker that assists clients with TCO applications.

CORONAVIRUS CRISIS HIGHLIGHTS IMPORTANCE OF AUSTRALIAN TRUSTED TRADER (ATT) BENEFITS

Even where traders are able to secure a transport route for their goods, another challenge has emerged relating to obtaining the certificates of origin required for China-Australia Free Trade Agreement (ChAFTA) preferential tariff treatment.

Due to the virus threat, Chinese Government offices have closed temporarily, making required to claim ChAFTA preference at the time of import. Importers have up to twelve months to provide the certificate of origin and seek a refund, however this can greatly impact the cash flow of your business and there is currently no certainty on when Chinese offices will reopen.
