WISHING YOU A MERRY CHRISTMAS & HAPPY NEW YEAR |
|
As we wind up another year, desperate hope is required for drenching rain across the country to give some relief to those suffering from the fires and the ongoing crippling drought.
From a logistics perspective, we remain hopeful that conditions will allow for sustainable crops to fill our ships and aircraft to support export markets.
FTA / APSA will continue our advocacy focus in the new year on stevedore imposed Infrastructure Surcharges and government / commerce imposed fees that continue to add salt to the wounds of the international trade sector, with a particular impact on our already suffering farmers and exporters.
On a personal note, on behalf of the APSA Committee of Management and the FTA team, Caroline and I sincerely thank all of our members and sponsors for your ongoing support.
We wish you and your families a safe, happy and healthy festive season and we look forward to again working with you in 2020.
Caroline and Paul Zalai - FTA / APSA |

Infrastructure Surcharges - update on advocacy activity |
|
FTA / APSA engaged with Minister Horne's office on Friday 6 December 2019 - we understand that Deloitte will be reporting findings of the Port Pricing and Access Review to the Minister before Christmas and will be engaging with FTA / APSA early in the new year.
We thank members (particularly exporters) for highlighting the impacts of these crippling fees and encourage more formal correspondence to me at pzalai@FTAlliance.com.au to add weight to our advocacy with regulators. |
|
We are gathering momentum and continue to receive exceptionally good coverage in the Australian Financial Review (AFR) who have committed to keep working on the story, next featuring the impacts on exporters |
|
"Paul Zalai, director of Freight & Trade Alliance, said it would continue advocacting for not just a cap in fees, but for fees to be wound back altogether.
Tthere is no issue with stevedores recovering costs or being profitable - but they need to do so through negotiations with their shipping line commercial clients and not holding road and rail operators to ransom with terminal access charges" Mr Zalai said ... read more |

UPDATED TERMS & CONDITIONS |
|
As highlighted in recent Goods Compliance Reports and media releases, the Australian Border Force (ABF) compliance focus is escalating - add to the mix rising global trade tension, the risks and complexity of providing customs and logistics services have never been greater.
At the same time, competition continues to create constant pricing pressures. This means that licensed customs brokers are often accepting high levels of risks for relatively low returns. If you cannot increase the returns, you can at least take steps to reduce the risks.
An important part of a customs broker's risk management strategy are its terms and conditions of trade. The T&Cs set out the rights and obligations of each party. They can be a shield against claims by your customers and also create important indemnity rights.
Freight & Trade Alliance (FTA) offers a package of commercial documents to FTA members, including T&Cs, letter of authority, director's guarantee and a credit application.
The T&Cs have recently been updated by Hunt & Hunt Lawyers to address the following;- further limit the circumstances where the unfair contract terms will apply;
- create additional rights where the customer is a trustee or agent;
- make clear that rates can be calculated based on volumetric conversion; and
- expand the scope of the customer indemnity.
The updated terms will be forwarded to members that have previously purchased the FTA T&Cs and will be included in the package provided to any new purchasers - read more
FREE WEBINAR - REGISTER HERE
Hunt & Hunt Lawyers will provide a free webinar at 12PM AEDT on Wednesday 29 January 2020 covering the following topics:
1. key elements of the FTA terms and conditions; 2. changes to the FTA terms and conditions; 3. incorporation of terms and conditions by email footer; and 4. unfair contract terms. |

A CALL FOR REGULATION TO END EXPONENTIAL INCREASES IN PORT ACCESS FEES |
|
In response to the Port Pricing and Access Review commissioned by the Victorian Government, Freight & Trade Alliance (FTA) and the Australian Peak Shippers Association (APSA) have outlined serious concerns regarding the exponential increases to port access fees (commonly known as 'infrastructure charges') at the Port of Melbourne.
APSA facilitated a workshop with key Port of Melbourne shippers to better understand the impacts of these increases on their businesses and used the meeting to reflect on the different State Government regulatory options put forward by the Australian Competition and Consumer Commission (ACCC) in their 2017-2018 Container Stevedoring Monitoring Report ... read more |
