Infrastructure Surcharges - update on advocacy activity |

Melbourne - as outlined in last weeks' member notice, the Victorian government commissioned a Port Pricing and Access Review led by Deloitte Access – a summary of the formal submission prepared by Freight & Trade Alliance (FTA) and the Australian Peak Shippers Association (APSA) is available HERE. FTA/APSA and the Container Transport Alliance Australia (CTAA) have reached out to Deloitte and Freight Victoria on an update on the release of recommendations and the Victorian government responses. Sean Richards (APSA Chair and EM Visy Logistics) and I are scheduled to meet Roma Britnell MP (Shadow Minister for Ports and Freight and Member for Warrnambool) in Melbourne on 12 November 2019 to elaborate on matters raised in the FTA / APSA submission .– for further detail contact pzalai@FTAlliance.com.au Fremantle – FTA / APSA provided a submission to Fremantle Ports on 27 Sept 2019 warning of the escalating threat of Infrastructure Surcharge increases to Western Australian operations and seeking intervention via the Ports' stevedoring leasing renewal arrangements - refer HERE. As outlined in Monday's notice from DP World Australia, these concerns have clearly come to reality with their Infrastructure Surcharge (now referred to as "Terminal Access Charge") scheduled to increase from $8.22 (excl GST) to $45 (excl GST) per container effective 1 January 2019 - refer HERE

"DP World's action is disappointing, given the substantial effort both parties have made to reach agreement on the new lease arrangements over the past months. It also confirms Fremantle Ports' concerns about the level of future infrastructure surcharges that may eventuate if no agreed approach is in place under the new lease.Fremantle Ports is currently considering its position with regard to longer-term lease arrangements at Fremantle. It will continue to strive for fair and reasonable commercial arrangements that are in the interests of all port stakeholders."

DCN - DPWA ANNOUNCES INFRASTRUCTURE FEE HIKES
Freight and Trade Alliance director Paul Zalai argued it was time for government agencies to consider intervention. "Only last week when Hutchison announced their increases at Port Botany, we stated it is obviously a lot easier for stevedores to turn up the infrastructure surcharge 'money tap' rather than absorbing costs or passing these on to their commercial client (shipping line)," Mr Zalai said. "Tomorrow being Melbourne Cup day we meet with the NSW Productivity Commissioner to explain the impacts on industry of this unregulated and anti-competitive charging regime – hopefully we pick a champion." ... read more |

DCN - Hutchison to hike infrastructure levy at Port Botany
HUTCHISON Ports Sydney has confirmed it will increase the infrastructure levy at Port Botany to $63.11 (exclusive of GST) from 18 November. The levy is to apply to all laden or full containers received or delivered by road or rail at the terminal. The current rate is $35.84, making the impact $27.27 per container. "The levy follows a review of investment in infrastructure at Port Botany and Hutchison Ports will continue to ensure sufficient capability is invested to serve the needs of the industry," the company said in a statement. Stevedores across the country have been applying infrastructure levies since early 20017. Freight and Trade Alliance director Paul Zalai said it was easier for a stevedore to turn up the "infrastructure surcharge money tap" rather than absorbing costs or passing these on to shipping lines. "Why wouldn't you take advantage of an unregulated arrangement to collect money from third parties," a caustic Mr Zalai said.

DCN - Law firms confirmed as legal counsel for FTA
LAW firm Mills Oakley has been confirmed as legal counsel for the Freight and Trade Alliance and Australian Peak Shippers Association, joining fellow firm Hunt & Hunt Lawyers who have been reappointed. FTA represents 370 key importers and freight forwarding businesses and serves as secretariat to APSA. FTA director and co-founder Paul Zalai said Mills Oakley would support members nationally on shipping, insurance, transport and logistics. Mr Zalai talked of the need for specialist support citing the cost of disputes, and of litigating them, being a major consideration in an industry dominated by controlling spend and protecting value. "The current economic climate and the increasingly globalised face of the shipping industry means that contractual relationships have become ever more complex, making sound legal guidance and expert handling of claims and recoveries more important than ever," he said.
