FEATURE ARTICLE Thank you once again to Matthew Morgan, Crowe Horwath for his article "IS YOUR BUSINESS COMPLIANT WITH CUSTOMS AND EXCISE DUTIES OBLIGATIONS" as a part of our Autumn 2019 edition of Across Borders
"Early in 2018, a Melbourne based import business was required to pay almost $2 million in penalties and recovered Duty and GST because an ABF investigation revealed that imported pre-galvanised steel products from a number of countries were undervalued"

FREIGHTWAVES 5.4.2019 - PORT REPORT: BOX FREIGHT RATES OUT OF CHINA HAVE "GONE TO HELL IN A HANDBASKET" "Southbound volumes have definitely softened and potentially we're still suffering the after-effects of Chinese New Year," said Travis Brooks-Garrett, director at Australia-based Freight & Trade Alliance. "As a result of the softer volumes we're also seeing the downsizing of vessels and a suspension of services. Freight rates have reflected that."

JOC.COM 4.4.2019 - AUSTRALIAN DOCKWORKERS CALL OFF DP WORLD STRIKE
When the strike action started two weeks ago, Australian shipper groups, including the Freight & Trade Alliance (FTA) and the Australian Peak Shippers Association (APSA), told JOC.com they were worried industrial action could spread to other terminals if the dispute wasn't resolved quickly.

DCN 3.4.2019 - EXPERT PANEL TO SET TO CAUSE A STINK FTA director Caroline Zalai said they were delighted with 170 registrations for the Sydney event already recorded. "This is an amazing response to the first of our 2019 series of events – we look forward to replicating these programs in Brisbane on 2 May and in Melbourne on 19 June," Ms Zalai said.
The full day program also provides 24 Continuing Professional Development points for customs brokers.
The event also provides the first of the year's Continued Biosecurity Competency sessions required by importers and customs brokers to maintain their accreditation.

AUSTRALIAN FINANCIAL REVIEW 1.4.2019 - DP WORLD REACHES PEACE DEAL WITH UNION
Freight and Trade Alliance director Travis Brooks-Garrett said the announcement of the 24-hour stoppages on Friday had "created alarm for high-volume importers and exporters" and "represented a major escalation of the dispute".
"DP World Australia Port Botany rail operations were shut over the weekend as a result of the dispute, creating additional fees and delays for major rural exporters who are dependent on rail operations," he said. "Again, we would call for an urgent resolution and for the parties to get back to the table for the good of the international trade sector."

DCN 2.4.2019 - STEVEDORES TO AXE "LIKELY UNFAIR CONTRACT TERMS"
The ACCC began its investigation early last year following concerns raised about alleged unfair terms.
The ACCC's 2018 Container Stevedore Monitoring Report noted the ACCC was assessing unfair contract terms within the industry. The ACCC has now concluded that assessment.
Freight and Trade Alliance director Paul Zalai said the result was "a significant result and an important step towards our advocacy for increased regulator intervention on stevedore landside operations". "The Container Transport Alliance of Australia can take credit for this positive outcome as the lead advocate for this particular reform," Mr Zalai said.

ATN 2.4.2019 - ACCC PREVAILS ON STEVEDORE TRIO TO REMOVE LIKELY UNFAIR CONTRACT TERMS
"The decision shows that the stevedores cannot act with impunity and that the regulator is not only monitoring the commercial arrangements at the wharf but they also have the powers and willingness to intervene when necessary," FTA director Travis Brooks-Garrett says.
"These wins are not just symbolic either. Addressing the liability for loss or damage suffered by transport businesses is a big step forward, particularly when cases of damaged equipment inside the terminal gates are not infrequent. "Unfortunately for Australia's shippers, shipping contracts, notoriously one-sided and unfair, are specifically excluded from the unfair contract terms protections.

| Global Finance Report
Weekly Market Commentary US Markets closed a very positive week strongly, despite no announcement on the US/China trade negotiations, although Non-Farm Payrolls beat expectations. NFP added 180,000 jobs for the month and the headline Unemployment rate remained at lows of 3.8%, boosting market confidence. President Trump has remained positive and said that markets will know within four weeks if an agreement will be reached. These negotiations were to be completed in March, so the delays are worrying, although the complex nature of the agreement rationalises the delays. President Trump was also on the attack with regards monetary policy again, advocating cuts to interest rates to trigger a 'rocket-ship' economy. The expected trade announcement failed to materialise, increasing fears of the global growth narrative, boosting the safety flows to the Dollar. The EUR traded 1.1200, while the GBP tests 1.3000 on the downside, completely drowned in Brexit chaos and impasse.. ... read more |
