Dear Customers and Partners,
I can confirm today that operations are running as normal across the entirety of the business.
I'm pleased to be able to confirm that fears of disruption to our business have been proven inaccurate, largely thanks to our amazing team, and the confidence of our customers and partners.
There were some initial disruptions in the first two days of the administration, while the Administrators established alternate accounts with terminals, and we resolved some issues with third party empty parks. Terminals were resolved by COB Friday 7 August and empty parks were resolved on the second trading business day following commencement of administration (Monday 10 August).
At that point, all business operations stabilised to business as usual. Specifically:
- There have been reports of redirections. Some shipping lines had begun redirections in the first 24 hours of the administration, before we had had opportunity to speak with them personally on day one being Friday 7 August. They were provided the appropriate warranties and assurances required to revert to BAU effective Monday 10 August.
- ACFS e-Depots nationally continue to operate BAU. Tyne ACFS is not subject to these matters, and continue to operate BAU.
- Any redirection requests received by us since Saturday 8 August have been on the basis of ISO-type being directed to third party empty depots directly resulting from customer demand on rail and road – not due to concern over the administration.
Additional guarantees
While our operations continue to run smoothly, I recognise that the industry is watching this administration process closely. I expect to be spending much of the coming weeks speaking with customers, partners and industry representatives as the administration continues to what I envisage to be the minimum period whilst the business is recapitalised.
To that end, the Administrators have confirmed the following arrangements for customers and partners with respect to cargo and equipment during the administration process:
- If a customer requires its goods held at one of our facilities to be relocated, we will cover the cost and arrangements for relocation of their goods to their nominated facility.
- If a customer prefers to engage a third party to complete a relocation task, we will reimburse or credit the cost of that relocation, based on our charge rate for the same transport.
- Customers will be credited the cost of any lifts or associated fees charged for relocation of goods under these arrangements, up to a certain amount.
- No lien, detention right or lock-up will be asserted over goods shipped by our company.
- Customers will continue to have unrestricted access to their equipment.
Regarding recapitalisation
While the Receivers are currently responsible for the financial management of ACFS Australia, a regular question to me over the past few days has been about the reasons for the administration, and what's next for the business.
Leading into the administration, cash flows of the business had been materially affected due to increased disbursement costs on inferior terms, significantly increased industrial leasing costs due to market rent reviews, and most importantly, material overdue debts to ACFS Australia beyond agreed credit terms.
I know many recipients of this letter are experiencing similar difficulties given current market and industry conditions. This administration process is allowing ACFS Australia to recapitalise its financial position and ensure it will be better placed to meet these industry challenges once it emerges from administration.
Prior to ACFS Australia being tipped into administration, the Tzaneros family had secured approval (subject to pre-completion conditions) for recapitalisation funding ahead of the administration appointment and remains fully committed to recapitalising the business. With the company now in administration, the family is working alongside the Receivers and Managers to secure the future of the business for our customers and employees.
Communication
We now have a FAQ section on our website administration information page, and will soon be introducing an email form to allow visitors to lodge questions with us. We will provide answers to BAU questions on the information page, while any questions regarding the administration process will be shared with the Receivers and Managers.
