MONITORING AUDITS DAFF’s upcoming Proactive Compliance Activities REGISTER NOW FOR CPD AND DEPOT FORUMS

Freight & Trade Alliance (FTA) and the Australian Peak Shippers Association (APSA) have approached the Department of Agriculture, Fisheries and Forestry (DAFF) to gain a clearer understanding of their 'proactive compliance activities' that they intend to launch across the supply chain.
 
As members would be well aware, DAFF is the lead regulatory agency responsible for safeguarding Australia's agricultural sector. This includes overseeing key legislation such as the Biosecurity Act 2015, the Export Control Act 2020, and the Imported Food Control Act 1992.
 
The Investigations Branch within the Compliance and Enforcement Division is committed to safeguarding Australia's biosecurity and trade integrity. As part of this commitment, we understand they will be conducting proactive compliance activities throughout the supply chain. These activities will utilise monitoring powers under Part 2 of the Regulatory Powers (Standard Provisions) Act 2014, as they apply to the above-mentioned legislation for the purposes of determining:

  • whether this Act has been, or is being, complied with; and
  • whether information given in compliance or purported compliance with this Act is correct.
In the event non-compliance is identified, DAFF will respond appropriately, ensuring that any enforcement response is proportionate. This can range from warnings, infringements, civil penalties, criminal prosecutions, suspensions and revocations (licences or approvals).
