MINISTER FOR TRADE - REVIEW ON INTERNATIONAL SHIPPING

Freight & Trade Alliance (FTA) and Australian Peak Shippers Association (APSA) representatives joined industry colleagues on Tuesday 7 September 2021 in a virtual 'roundtable' meeting with The Hon. Dan Tehan, Minister for Trade, Tourism and Investment.

FTA/APSA POSITION

The FTA/APSA advocacy was summarised in an allocated two minutes presentation to the Minister that focussed on 1. Competition Reform; 2. Notification & Minimum Service Levels; and 3. Terminal Access Charges - a copy of  FTA/APSA briefing is available HERE

As outlined in yesterday's live to air ABC commentary, FTA/APSA will continue its advocacy momentum to highlight the adverse economic impacts of the shipping crisis through further case studies and ongoing media coverage

ACCC INVESTIGATION - SHIPPING LINE ANTI-COMPETITIVE BEHAVIOUR

In parallel to the Ministerial lead for a shipping review, and as outlined by Rod Simms (Australian Competition and Consumer Commission Chair) in The Australian ACCC probes shipping cost surge, the ACCC is conducting a separate examination on international containerised shipping line practices

EXTRACT: The Australian

"There is a limited amount I can say on it, but we are looking at the freight system – particularly the role that containers play, I can certainly say that, and that is certainly on the list of investigations
"We are aware of what's going on with containers, and we are investigating it.
"It is not a cartel activity (investigation); it is anti-competitive behaviour. It is not necessarily massively advanced but it is something we are looking at."


FTA/APSA POSITION

As outlined in our formal submission to the ACCC, FTA/APSA is advocating for repeal Part X of the Consumer & Competition Act 2010 that currently provides broad exemptions from competition law for registered shipping lines to coordinate with each other in transporting cargo to, or from, Australia.

Shipping line market consolidation plus the emergence of stevedore-imposed Infrastructure Surcharges has resulted in supply chain costs rapidly increasing, exposing significant deficiencies in the effectiveness of Part X in being able to achieve basic shipper protections.

Importantly the submission endorsed the ACCC (or the establishment of a Federal Maritime Regulator should some form of block exemption be introduced) as being the appropriate entity to oversee shipping competition reform recognising its track record of strong compliance enforcement (notably a 2019 criminal cartel prosecution against a major shipping line for price fixing in relation to an unregistered agreement, resulting in an order by the Federal Court to pay a fine of $34.5 million).

FURTHER DETAIL

FTA/APSA is continuing engagement direct with the Trade Minister's office and ACCC executive - we expect more detail in coming days in terms of the scope of both the ship[ping review and investigation and will keep members informed on next steps.
