Legal application to prevent industrial action at DP World Sydney

Freight & Trade Alliance (FTA) and the Australian Peak Shippers Association (APSA) have received advice that DP World has submitted an application with the Fair Work Commission (FWC) to have industrial action at their Port Botany terminal terminated because of its potential to cause significant damage to the Australian economy and to NSW in particular - DPWA customer notice below.

Dear Customers,

On Tuesday 15 September, DP World Australia (DPWA) lodged an application with the Fair Work Commission (FWC) to have industrial action at our Port Botany terminal terminated because of its potential to cause significant damage to the Australian economy and to NSW in particular.

This application will be heard by the FWC on Saturday 19 September and we would expect to have a decision shortly after.

We have made this application because we believe industrial action proposed at Port Botany endangers supply chains for critical products and exports and puts unacceptable pressure on the economy. 

We've been bargaining for nearly two years now. It's been a protracted process punctuated by several rounds of industrial action and by the union abandoning agreed positions on multiple occasions.

DPWA has recently seen a return to normal productivity on the back of an in-principle agreement with the union. The recently advised industrial action threatens the overall agreement and we have sought the intervention of the FWC to enable us to finalise the Enterprise Agreement.

The customer centre and our operations teams will work with you to mitigating the impact of any service disruption.
